Damian M. Moos
Damian Moos represents and counsels clients throughout Southern California in connection with general business and contract disputes, employment matters, intellectual property and licensing, unfair competition, data collection and privacy, and false and deceptive advertising matters. He represents clients in a variety of industries, including digital advertising and telemarketing, transportation and logistics, real estate and lending, and construction and manufacturing. He appears for clients in litigation in both state and federal courts, and defends class actions and representative actions.
Damian’s practice includes:
- Advising and representing clients in matters involving the federal Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state anti-spam statutes such as California Business & Professions Code section 17529.5 and the California Consumer Privacy Act (CCPA)
- Advocating and litigating business-to-business disputes involving breach of contract claims, affiliate marketing disputes, unfair competition and unlawful interference, trade secret misappropriation, intellectual property infringement, partnership disputes and collections matters
- Defending employers in class actions, representative PAGA actions and individual actions involving wage and hour disputes, independent contractor misclassification, meal and rest break violations, minimum wage and overtime, commission and piece rate pay disputes, itemized statement violations and failure to reimburse for business expenses
- Advising and representing clients in matters involving brokers and agency, officer and director liability, fiduciary duties and state licensing
- Advising and representing clients in connection with their data collection, use and privacy practices, including drafting and reviewing website terms and privacy policies
Prior to joining Best Best & Krieger LLP’s Irvine office as a partner, Damian was a founder and partner at Kang Spanos & Moos LLP. He also served as the general counsel of two companies in the online advertising industry. In that role, he handled all of their legal matters, including litigation and disputes, contract drafting and negotiation, creating and implementing compliance programs and procedures and employment-related matters. He also previously worked at one of the country’s largest law firms, where he represented nationally recognized companies such as Qualcomm, Morgan Stanley, Hyundai and KPMG. He handled a variety of matters ranging from consumer class actions, contract disputes, unfair competition and trade secret misappropriation, and broker-dealer arbitrations.
