Best & Krieger Deputy Director of PRA Services and E-Discovery Counsel Darren Ziegler and Advanced Records Center Staff Attorney Kathryn Romo authored an article in the Daily Journal about the legislative changes to Penal Code Section 832.7 and the challenges law enforcement agencies face regarding California Public Records Act (CPRA) requests.
“The legislature and the courts have made clear that increased transparency in policing is critically important (with some carve-outs for agencies to withhold records in particular circumstances)," stated by Ziegler and Romo. "However, the general rule that police personnel records are confidential remains, and many investigations into alleged misconduct do not fit neatly into the categories outlined for mandated disclosure.”
