The California Voting Rights Act (CVRA) presents very low hurdles for petitioners demanding by-district elections in special districts and thus great exposure to districts unprepared for those demands. What can your district do now to mitigate the exposure if a demand arrives? It’s anticipated that the California Supreme Court will soon decide Pico Neighborhood Ass’n v. Santa Monica. Courts hearing that case have applied very different interpretations to the CVRA’s prohibition on “racially polarized voting” and a wave of CVRA demands could follow.
