Best Best & Krieger LLP (BBK) Partner and Director of Government Affairs, Ana Schwab, was quoted in an article published by Bloomberg Law addressing the legal and regulatory challenges wastewater utilities face with per- and polyfluoroalkyl substances (PFAS) in biosolids. 

Schwab emphasizes that utilities are in a difficult situation. They are expected to meet regulatory requirements without the necessary cleanup technologies or federal standards in place. Her concerns underscore the liability risk that utilities face under the Superfund law after the Environmental Protection Agency classified certain chemicals as hazardous substances. 

Because of the legal gaps that wastewater utilities adapt to as they navigate the evolving regulatory landscape, Schwab brings to attention the need for legislative protections. Without practical protections, wastewater utilities may be unfairly held responsible for contamination they did not create.
